Terms of Service
www.lizdube.com | Liz Dubé, MA, MS, LMFT, CST | Sex & Relationship Therapist
1. Agreement to These Terms
Welcome to lizdube.com (the “Website”), operated by Liz Dubé (“Liz,” “we,” “us,” or “our”).
These Terms of Service (“Terms”) apply to your use of the Website, the Intimacy Season Quiz, newsletters and email list, blog and educational content, free resources, and events (together, the “Services”).
By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services. If you use a third-party service linked from the Website, that service’s own terms and policies also apply.
Liz Dubé is an AASECT Certified Sex Therapist and a California Licensed Marriage & Family Therapist (License #80113).
2. Educational Purposes Only
Content on the Website and in emails, the quiz, social media posts, and events is provided for general educational and informational purposes only.
It is not therapy, counseling, medical care, legal advice, or a diagnosis, and it is not a substitute for individualized professional care.
The Intimacy Season Quiz and other resources are reflective or educational tools, not clinical assessments. They cannot diagnose a condition or determine what treatment is appropriate. If you have a health concern, consult a qualified provider.
3. No Therapist-Client Relationship
Using the Website, taking the quiz, subscribing to the email list, sending a message through a contact form, or attending an educational event does not create a therapist-client relationship with Liz.
A therapist-client relationship begins only after:
- You complete the required consultation or intake process.
- Liz agrees to accept you as a client.
- You sign the required informed consent and related client paperwork.
Until a therapist-client relationship is established, messages sent through the Website, ordinary email, or social media are not confidential therapy communications.
Do not send detailed private, health, or sexual information through those channels.
4. Not for Emergencies
The Services are not intended for crisis or emergency situations. Messages and forms are not monitored continuously.
- If you are in immediate danger or experiencing a medical emergency, call 911 in the United States or your local emergency number.
- If you are in the United States and experiencing suicidal thoughts or an emotional crisis, call or text 988, or go to the nearest emergency department.
5. Adults Only; Sensitive Content
The Website discusses sexuality, intimacy, and sexual health for educational purposes.
You must be at least 18 years old to use the Services. By using them, you represent that you are at least 18 and are legally able to agree to these Terms.
6. Therapy Services and Consultations
Information about therapy services on the Website is general information and may change.
Fees, session length, cancellation rules, telehealth arrangements, confidentiality, and other treatment terms are provided during consultation and in client paperwork. The signed client paperwork controls the therapy relationship if it conflicts with general Website information.
Therapy services are provided in accordance with applicable licensing requirements. Services are currently offered to clients who are physically located in California at the time of the session, subject to eligibility and professional requirements.
Therapy outcomes vary, and no particular result is guaranteed.
7. The Intimacy Season Quiz and Free Resources
The quiz and free resources are educational tools.
To receive a full quiz result or resource, you may be asked to provide your first name and email address and sign up for email communications. Email communications and unsubscribe choices are described in the Privacy Policy.
Answer the quiz for yourself and do not submit another person’s information without their permission.
Quiz results are generalized and may not fully reflect your individual experience. We may modify, pause, or discontinue the quiz or any free resource at any time.
8. Events and Community Chats
Registration and payment
Registration and payment for events may be handled by Eventbrite or another third-party platform. The platform’s terms, privacy policy, and payment terms also apply.
Not therapy
Community chats and workshops are educational and conversational. They are not group therapy and do not create a therapist-client relationship.
Respect and privacy
Attendees are asked to respect others’ privacy, but we cannot guarantee that other attendees will keep information confidential.
Do not record, photograph, or share identifying information about another attendee without that person’s permission.
Conduct
We may remove an attendee whose behavior is disruptive, harassing, disrespectful, or unsafe, subject to applicable law.
Changes and cancellations
We may change an event’s date, time, venue, or format, or cancel an event.
9. Email and Communications
By subscribing to the email list, you agree to receive the types of emails described at signup and in the Privacy Policy. Marketing emails include an unsubscribe mechanism. You may unsubscribe at any time.
Email, social media, and Website forms may not be secure or confidential. Do not use them to communicate urgent matters or to send detailed clinical information.
We are not responsible for delays caused by email providers, spam filters, or technical issues.
10. Intellectual Property
Unless otherwise stated, content on the Website and within the Services—including text, graphics, logos, quiz questions and results, blog posts, videos, photographs, downloads, and design—is owned by Liz Dubé or used with permission and is protected by intellectual property laws.
You may view the content and share links for personal, non-commercial use.
You may not copy, reproduce, republish, distribute, sell, license, modify, create derivative works from, or commercially exploit Website content without prior written permission, except where applicable law permits otherwise.
When quoting or sharing permitted excerpts, provide appropriate credit and a link to the original page.
11. Acceptable Use and Security
You agree to use the Services lawfully and respectfully. You must not:
- Use the Services to harass, threaten, defame, exploit, impersonate, or harm another person.
- Submit information that is knowingly false, misleading, unlawful, or belongs to another person without authorization.
- Attempt to gain unauthorized access to the Website, accounts, servers, or connected systems.
- Probe, scan, test, bypass, or interfere with Website security or authentication without written authorization.
- Scrape, harvest, copy, or collect Website content or personal information through automated means, except as permitted by law or with our written permission.
- Introduce malware, malicious code, or other harmful material, or overload, disrupt, or impair the Website.
- Use automated tools or scripts to manipulate quiz results, create bulk signups, or interfere with forms or events.
- Copy, reproduce, or commercially exploit the quiz, its questions, or results without written permission.
We may investigate suspected violations and restrict, suspend, or terminate access to the Services when reasonably necessary to protect the Website, users, or our rights, subject to applicable law.
12. User Submissions and Testimonials
If the Website allows comments, reviews, testimonials, or other submissions, you are responsible for the content you submit and must have the rights and permissions needed to submit it.
Do not submit unlawful, defamatory, harassing, misleading, infringing, or confidential information about another person.
We may remove or decline to publish submissions that we reasonably consider inappropriate, unlawful, harmful, or inconsistent with these Terms. We do not promise to monitor all submissions and are not responsible for user-generated content posted by others.
Testimonials, where published with permission, reflect individual experiences and do not guarantee or predict another person’s results. A testimonial is not a promise of a particular therapy outcome.
13. Third-Party Links and Services
The Website may link to or use third-party services, including Eventbrite, Brevo, social media platforms, video providers, payment processors, and other external services.
We do not control third-party websites or services and are not responsible for their content, availability, terms, privacy practices, or security.
Your use of those services is governed by their own terms and policies.
14. Disclaimer of Warranties
The Services are provided “as is” and “as available,” to the fullest extent permitted by law.
We do not warrant that the Services will be accurate, complete, uninterrupted, secure, error-free, available at all times, or suitable for your particular needs. Website content may become outdated, and we do not undertake to update every item.
Your use of and reliance on the Services is at your own risk.
Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.
15. Limitation of Liability
To the fullest extent permitted by law, Liz Dubé and persons working with her will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunities, arising out of or related to your use of or inability to use the Services.
These Website Terms do not replace or modify any rights or obligations in a separate therapy agreement.
16. Indemnification
To the extent permitted by law, you agree to be responsible for claims, losses, liabilities, and reasonable expenses (including reasonable attorney’s fees) arising from your unlawful use of the Services, your material violation of these Terms, or your infringement of another person’s rights.
This provision does not apply to the extent a claim results from our own negligence, willful misconduct, or conduct for which liability cannot legally be shifted to you.
17. Governing Law and Disputes
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
Subject to any non-waivable legal rights, disputes relating to these Terms or the Website Services will be brought in the state or federal courts located in Los Angeles County, California, and the parties consent to the jurisdiction of those courts.
18. Changes to the Services and These Terms
We may modify, suspend, or discontinue all or part of the Services at any time.
We may also update these Terms. When we do, we will revise the “Last updated” date above and, where appropriate, provide additional notice.
Changes take effect on the stated date. Your use of the Services after the updated Terms take effect indicates acceptance of the revised Terms, to the extent permitted by law.
19. General
These Terms and the Privacy Policy form the agreement between you and us concerning your use of the Website Services, except for separate written agreements that apply to specific services, including therapy services or event registrations.
If any provision is found unenforceable, the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver.
You may not assign or transfer your rights or obligations under these Terms without our prior written consent, except where applicable law provides otherwise.
